Terms of Service

1. Acceptance of Terms

By accessing or using the Parivaar Pro platform ("Service"), including the website at parivaarpro.in and any associated applications, you ("User", "you") agree to be bound by these Terms of Service ("Terms"). If you do not agree, you must not use the Service.

The Service is operated by Parivaar Pro ("we", "us", "our"), a digital product developed and maintained in India.

2. Eligibility

You must be at least 13 years of age to create an account. If you are under 18, you represent that a parent or legal guardian has reviewed and consented to these Terms on your behalf.

3. Accounts & Authentication

You may access the Service through a Google account, email and password, or as an anonymous guest. You are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account.

• Guest Mode. Guest sessions store data locally in your browser and may be lost if browser data is cleared. Guest users may link their session to a permanent account at any time.
• Account Security. You agree to notify us immediately of any unauthorized use of your account. We are not liable for losses arising from unauthorized access that you fail to report.
• Account Termination. We reserve the right to suspend or terminate accounts that violate these Terms, engage in abusive behaviour, or remain inactive for more than 24 consecutive months.

4. Service Description

Parivaar Pro is a web-based family tree builder designed for Indian families. It provides an interactive canvas for mapping family relationships with automatic Hindi relation labels, cloud synchronization via Google Firebase, photo uploads, GEDCOM import and export, timeline views, family statistics, and sharing capabilities.

We reserve the right to modify, update, or discontinue any feature of the Service at any time. Material changes will be communicated through the Service or via email where possible.

5. Plans, Payments & No-Refund Policy

5.1 Free Plan

The free plan permits up to 20 family members, Hindi relation labels, and basic cloud synchronization at no cost. Free plans are subject to fair-use limits and may be modified with reasonable notice.

5.2 Lifetime Pro Plan

The "Anant Parivaar" plan is a one-time payment of ₹1,499 (Indian Rupees) that unlocks unlimited members, full GEDCOM import and export, unlimited photo uploads, advanced statistics, and role-based editor invites. This upgrade is perpetual, with no recurring subscription charged.

5.3 Payment Processing

Payments are processed through third-party payment processors (e.g., Razorpay). We do not store your credit card, debit card, or UPI credentials. All transactions are subject to the payment processor's terms and privacy policy.

5.4 No-Refund Policy

All purchases are final and non-refundable. The Pro upgrade is a digital product that is delivered immediately upon purchase. By completing the payment, you acknowledge and agree that you will not be entitled to a refund under any circumstances, including but not limited to change of mind, dissatisfaction with features, or failure to use the product after purchase.

In the rare event of a duplicate charge or a technical error where the upgrade was not applied to your account, you may contact us at hello@parivaarpro.in with your registered email address and transaction reference. Such cases will be reviewed on a case-by-case basis at our sole discretion, but do not constitute a guaranteed entitlement to a refund.

6. Referral Programme

Parivaar Pro offers a referral programme that allows users to earn cash rewards ("Referral Earnings") when a referred user purchases the Pro plan. By participating in the programme, you agree to the following terms:

• Earning Rewards. You earn ₹50 per successful referral conversion when a user you referred purchases the Pro plan. Earnings are credited to your Parivaar Pro account balance.
• 15-Day Conversion Window. A referred user must purchase the Pro plan within 15 days of applying your referral code. If the referred user does not upgrade within this window, the referral will expire and no reward will be granted.
• Withdrawal. You may withdraw your Referral Earnings to your registered UPI ID or bank account. The minimum withdrawal amount is ₹50. Withdrawals are processed within 3-5 business days after approval. You may submit up to 5 withdrawal requests per 7-day period.
• Withdrawal Eligibility. You may request a withdrawal 24 hours after your latest referral earning is credited. You must provide a valid UPI ID or bank account details (account number, IFSC code, and account holder name) before submitting a withdrawal request.
• Earning Limits. Referral Earnings are capped at ₹15,000 per user account. Earnings are awarded at the rate displayed in the app at the time of the referred user's Pro conversion.
• Non-Transferable. Referral Earnings are personal to your account, cannot be sold, bartered, or transferred, and are forfeited upon account deletion.
• Tax Responsibility. You are solely responsible for any tax obligations arising from Referral Earnings, including but not limited to income tax and TDS (Tax Deducted at Source) as applicable under Indian tax law. Parivaar Pro may withhold TDS on payouts as required by law.
• Programme Changes. We reserve the right to modify the reward amount, earning cap, withdrawal terms, or discontinue the referral programme at any time with reasonable notice. Accrued and unwithddrawn earnings at the time of programme modification will be honoured under the terms in effect at the time they were earned.
• Prohibited Conduct. Self-referrals, fraudulent signups, automated or scripted referrals, and any abuse of the programme will result in forfeiture of all earnings, reversal of payouts, and may lead to account suspension.

7. User Content & Data Ownership

You retain full ownership of all content you upload or enter into the Service, including family member profiles, photographs, notes, and relationship data ("User Content").

• Licence to Operate. By using the Service, you grant us a limited, non-exclusive, worldwide licence to store, process, and transmit your User Content solely for the purpose of providing and improving the Service.
• No Sale or Sharing. We do not sell, rent, license, or share your User Content with any third party for their own purposes.
• Export Rights. You may export your data at any time in JSON, GEDCOM, or PNG format. We will never hold your data hostage.

8. Prohibited Conduct

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable law.
• Upload content that is defamatory, obscene, fraudulent, or infringes the rights of others.
• Attempt to gain unauthorized access to other users' accounts or data.
• Reverse engineer, decompile, or extract the source code of the Service.
• Use automated systems (bots, scrapers) to access the Service without prior written consent.
• Circumvent usage limits, security features, or payment requirements.
• Impersonate any person or entity, or misrepresent your affiliation with any person or entity.

9. Intellectual Property

All rights, title, and interest in the Service, including the software, design, branding, Hindi relation engine, layout algorithms, and documentation, are owned by Parivaar Pro and are protected by applicable intellectual property laws. These Terms do not grant you any right to use our trademarks, logos, or branding without prior written consent.

10. Third-Party Services

The Service relies on third-party infrastructure and services, including but not limited to Google Firebase (authentication, database, storage, hosting), Razorpay (payment processing), and DiceBear (avatar generation). We are not responsible for the availability, accuracy, or policies of these third-party services. Your use of such services is subject to their respective terms.

11. Astrology & Jyotish Tools Disclaimer

Parivaar Pro offers several tools based on Vedic astrology (Jyotish Shastra), including but not limited to the Janam Kundali generator, Daily Rashifal / Horoscope, Manglik Dosha Check, Kundali Matching (Guna Milan), Muhurat Finder, and Cosmic You identity reveal (collectively, "Astrology Tools").

• Entertainment & Education Only. All Astrology Tools are provided strictly for educational and entertainment purposes. They do not constitute professional advice of any kind — medical, legal, financial, psychological, or otherwise.
• Not Scientifically Validated. Vedic astrology is a traditional knowledge system and is not a scientifically validated method of prediction. We make no claims regarding the accuracy, reliability, or predictive value of any output generated by the Astrology Tools.
• No Reliance on Output. You agree not to make important life decisions — including but not limited to marriage, career changes, health treatment, financial investments, or legal matters — based solely on the output of the Astrology Tools. Always consult qualified professionals for matters requiring expert judgement.
• No Liability. Parivaar Pro and its creators assume no responsibility or liability for any decisions made, actions taken, or outcomes experienced as a result of reliance on the astrological content generated by the Astrology Tools.
• Computational Basis. The Astrology Tools use astronomical calculations (e.g., VSOP87 planetary theory) to compute planetary positions and derive astrological interpretations algorithmically. This does not imply scientific endorsement of the interpretive framework.

12. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components. Genealogical relationship labels generated by the Service are computed algorithmically and may not reflect every regional or cultural naming convention.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, PARIVAAR PRO AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• Your access to or use of (or inability to access or use) the Service;
• Any conduct or content of any third party on the Service;
• Unauthorized access to, alteration of, or destruction of your data;
• Any other matter relating to the Service.

Our total cumulative liability shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.

14. Indemnification

You agree to indemnify and hold harmless Parivaar Pro and its affiliates from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising out of your use of the Service, your User Content, or your violation of these Terms.

15. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of India, without regard to conflict of law principles. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in New Delhi, India.

Before initiating formal proceedings, both parties agree to attempt resolution through good-faith negotiation for a period of at least thirty (30) days.

16. Modifications to Terms

We may revise these Terms at any time by posting the updated version on this page and updating the "Last Updated" date. Material changes will be notified through the Service or via email. Your continued use of the Service after such changes constitutes your acceptance of the revised Terms.

17. Severability & Waiver

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect. Our failure to enforce any right or provision shall not constitute a waiver of that right or provision.
